Terms and conditions for participants in practical workshops on the use of 3D hernia meshes adopted to patient’s needs in hernia repair

  1. These terms and conditions (hereinafter referred to as the Terms and Conditions) specify rules for participation in practical workshops on the use of 3D hernia meshes adopted to patient’s needs in hernia repair (hereinafter referred to as the Workshop), that shall be held on September 14, 2021.
  2. The Organiser of the Workshop (hereafter referred to as the Workshop) shall be Toruńskie Zakłady Materiałów Opatrunkowych Spółka Akcyjna with their registered office in Toruń, at at Żółkiewskiego 20/26, 87-100 Toruń, registered in a register of entrepreneurs at the District Court in Toruń, 7th Commercial Division of the National Court Register (KRS) with a KRS number 0000011286, VAT No. 8790166790, BDO 000013635, and share capital of PLN 2,640,000, including the capital paid in PLN 2,640,000.
  3. The aim of the Workshop is to popularise amongst physicians knowledge about possibilities to use hernia meshes offered in the commercial range of the Organiser to repair hernias.
  4. The crucial part of the Workshop shall be procedures of surgical hernia repairs performed and discussed by Professor Maciej Śmietański, MD, PhD at the Matopat Hospital in Toruń, including answering Participants’ questions. The Participant shall take part in the Workshop through an online transmission on the Youtube channel, and can ask questions through the chat.
  5. A detailed agenda of the Workshop forms an appendix to these Terms and Conditions. The Organiser reserves a right to depart from the Workshop agenda, when it is found necessary due to a course of the procedures.
  6. Taking into account the medical nature of the Workshop, only a physician licensed to practice in Poland can be the participant in the Workshop (hereinafter referred to as the Participant).
  7. To participate in the Workshop, the Participant should register by completing a registration form made available by the Organiser at https://matopat.pl/category/szkolenia/ no later than on September 12, 2021.
  8. The Participant can resign from participation in the Workshop by sending an email to marta.krzyzanowska@tzmo-global.com, containing a statement of their will to resign from participation in the Workshop.
  9. By registering the Participant’s participation in the Workshop (according to section 7), an agreement shall be concluded between the Organiser and that Participant concerning participation in the Workshop under these Terms and Conditions, i.e., the Organiser undertakes to enable the Participant to take part in the Workshop, and the Participant can take part in the Workshop under these Terms and Conditions.
  10. The Participant shall be obliged to participate in the Workshop in a way consistent with current legislation and good practices.
  11. The Participant shall not be obliged to pay any fees to the Organiser for their participation in the Workshop.
  12. The Organiser shall not be held responsible for any interruptions in the Participant’s participation in the Workshop (in particular, failure of the online transmission or interruptions in the online transmission, no option to ask questions through the chat, etc.) resulting from technical problems or technical limitations of computer software, an end device, an IT system, and a telecommunication infrastructure used by the Participant.
  13. The Participant gives their consent, free of charge, to the Organiser to record the Workshop on the video, also including questions asked by the User through the chat, process that video recording, and to distribute that video recording in any form, without any time or territorial limitations.
  14. The Organiser shall process the personal data of the Users provided to the Organiser, and therefore, informs hereby:
    1. Personal data shall be processed under provisions of the current legislation, and in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).
    2. The Data Controller shall be the Organiser, i.e., Toruńskie Zakłady Materiałów Opatrunkowych Spółka Akcyjna, ul. 20/26 Żółkiewskiego Street, 87-100 Toruń,
    3. The legal basis for processing of the personal data shall be Article 6.1 a) of GDPR, i.e., the data subject gave its consent to processing of their personal data for a specific purpose.
    4. The personal data shall be processed for the following purposes:
      1. the Participant’s participation in the Workshop and handling of the said participation;
      2. marketing activities of the Organiser, i.e., providing commercial information, publications, and marketing information and materials (if the User has given their additional consent to that).
    5. Recipients of the personal data shall be persons employed by the Organiser, and other trusted entities cooperating with the Organiser - to the extent necessary to pursue the above processing purposes; the personal data can also be made available to public authorities and other entities authorised under relevant legislation, on their request.
    6. The personal data shall not be transferred to any third country or international organisation.
    7. The personal data shall be stored until the above-mentioned processing objectives are fulfilled.
    8. The Participant shall be entitled to request from the Organiser an access to their personal data, and, in the cases specified in GDPR, to rectify, transfer, and delete it or to limit its processing.
    9. The Participant shall be entitled to withdraw their consent at any time, without affecting a conformance with a right to process under the consent before its withdrawal; the consent can be withdrawn, e.g., by sending a message with a statement of withdrawal of their consent to the following e-mail address: marta.krzyzanowska@tzmo-global.com.
    10. The Participant shall be entitled to complain to the President of the Personal Data Protection Office when they decide that processing of their data is in breach of GDPR.
    11. Providing of personal data is not a statutory or contractual requirement, and is voluntary; however, when the data is not provided, the above-mentioned processing purposes cannot be fulfilled, i.e., prevents the User participation in the Training and prevents the marketing activities of the Organiser addressed to the Participant.
    12. The Participant’s personal data shall not be subject to automated decision-making, including profiling.
    13.   15. The Organiser shall be entitled to change these Terms and Conditions for important reasons, independent of the Organiser.
